NWGB Joins SAPS and NPA to Tackle Illegal Gambling in South Africa

The North West Gambling Board (NWGB) has joined the South African Police Service (SAPS) and the National Prosecuting Authority (NPA) in a Back-to-Basics training initiative aimed at strengthening law enforcement, improving investigations and enhancing the prosecution of offenses, including illegal gambling.

The training, held at Rio Hotel Casino in Klerksdorp, focused on the legal and practical challenges affecting successful prosecutions and the importance of closer cooperation between investigators and prosecutors. Presentations by Advocate Van Biljon and Simon Mogapi highlighted the legal frameworks governing cybercrime, racketeering and illegal gambling.

They also emphasized the need for proper evidence collection, adherence to prescribed procedures and effective coordination throughout the criminal justice process. A key issue raised during the engagement was the difficulty of securing successful prosecutions against illegal gambling operators.

Challenges include cases being withdrawn, incorrectly completed notices to appear in court, insufficiently documented evidence and arrests involving employees rather than the owners and beneficiaries of illegal gambling operations. These shortcomings can undermine enforcement efforts and make it more difficult to hold those responsible for illegal gambling activities accountable.

The discussions highlighted the need for investigators to establish clear links between alleged offenses and the individuals who own, finance or profit from unlawful gambling operations. Mogapi stressed that illegal gambling extends beyond the operation of unlicensed machines and premises, warning that the activity can have broader consequences for communities.

These include exposing children to gambling, undermining lawful economic activity and raising concerns about the movement of proceeds generated through illegal operations. The concerns reinforce the importance of effective enforcement measures that address not only the visible operations of illegal gambling businesses but also the individuals and networks benefiting from them.

The NWGB has made progress in disrupting illegal gambling activities through enforcement operations, the closure of unlawful gambling sites and the seizure and destruction of illegal machines. However, the Board acknowledged that sustained progress requires stronger partnerships, improved investigative capacity and a coordinated approach to identifying and prosecuting those responsible for such operations.

The training initiative provided an opportunity for participating agencies to examine procedural weaknesses, share practical insights and identify ways to improve the handling of illegal gambling cases. The engagement underscores the importance of continued cooperation between the NWGB, SAPS and the NPA in strengthening enforcement and improving prosecution outcomes.

By addressing investigative shortcomings and reinforcing collaboration between law enforcement officers and prosecutors, the agencies aim to improve the effectiveness of interventions against illegal gambling. The initiative also highlights the need to ensure that enforcement efforts extend beyond front-line operators to those who own, finance and benefit from illegal gambling activities, supporting accountability and the protection of communities across South Africa.
