The debate surrounding the proposed Central Gaming Bill, which sought to amend Nigeria’s National Lottery Act, has been conclusively resolved following a clear reaffirmation of Nigeria’s constitutional framework by President Bola Ahmed Tinubu.
Over recent months, the bill triggered widespread concern among state governments and industry stakeholders, particularly over questions of constitutional jurisdiction. At the heart of the debate was whether the regulation of lottery and gaming should be centralized at the federal level or remain within the legislative competence of the states.
These concerns were amplified after the Supreme Court’s 2024 judgment, which affirmed that lottery and gaming regulation is a residual matter reserved for states, except where activities occur within the Federal Capital Territory (FCT). Several states, including Lagos, consistently maintained this position, arguing that any centralized regulatory framework would conflict with constitutional provisions.
In response, the Lagos State Lotteries and Gaming Authority (LSLGA), working alongside sister state regulators, engaged stakeholders across the industry to emphasize the importance of federalism, the rule of law, and respect for Nigeria’s constitutional order. Regulators warned that a central gaming authority could undermine state autonomy, weaken regulatory efficiency, and disrupt existing lawful structures already operating across the federation.
The matter has now been laid to rest following President Tinubu’s unequivocal position that lottery and gaming regulation remains within the constitutional authority of state governments, in line with Nigeria’s federal structure. The President’s stance effectively resolves the uncertainty created by the proposed bill and reinforces the supremacy of constitutional democracy.
Reacting to the development, Lagos State reaffirmed its commitment to responsible gaming, consumer protection, investor confidence, and continued collaboration with industry stakeholders—within a constitutionally lawful framework.
The state also commended the Governor of Lagos for his steadfast defence of the rule of law, as well as President Tinubu for his firm commitment to upholding constitutional governance.
With this resolution, regulatory certainty has been restored, ensuring that Nigeria’s gaming industry continues to operate within clearly defined constitutional boundaries.
